SK Xperience Terms and Conditions

1. Acceptance of Terms

By participating in any of the activities offered by SK Xperience, you (the "Participant") agree to be bound by and accept the following Terms and Conditions and the accompanying Waiver of Liability and Release. SK Xperience is a partnership between Ster-Kinekor Theatres and Jozi X (Pty) Ltd. All activities are provided by Jozi X and take place at Ster-Kinekor Theatres venues.

2. Assumption of Risk and Waiver of Liability

Participation in the activities offered by SK Xperience, which include, but are not limited to, Gel Shots, Splatter Room, Arch Rivals, Nerf Warz, Axe Throwing, and Rage Room, involves inherent and significant risks of injury. These risks include minor injuries such as cuts, scrapes, bruises, and sprains, as well as severe injuries, including but not limited to, fractures, head injuries, and other long-term disabilities or, in rare cases, even death.

The Participant understands and voluntarily assumes all risks associated with participation in these activities, whether known or unknown, and regardless of their cause. The Participant releases, indemnifies, and holds harmless SK Xperience, Ster-Kinekor Theatres, Jozi X, and their respective affiliates, officers, directors, employees, and agents from any and all claims, liabilities, damages, or causes of action (including legal fees) arising from any personal injury, property damage, or loss sustained by the Participant or a third party, which is in any way connected to participation in these activities.

This Waiver of Liability and Release is a binding legal document that must be signed by the Participant (and a Parent/Guardian for minors) before any activity begins.

3. Rules of Participation

The Participant is solely responsible for their own safety and for following all rules and instructions provided by SK Xperience and Jozi X staff. The onus is on the Participant or their Parent/Guardian to ensure safe gameplay. This includes, but is not limited to:

Following all verbal and written safety instructions and rules.

Using all provided equipment as instructed and for its intended purpose.

Reporting any equipment malfunction, unsafe condition, or injury immediately to staff.

Avoiding any conduct that could endanger themselves or others.

Failure to adhere to these rules may result in immediate expulsion from the activity without a refund.

4. Age Restrictions and Parental Consent

Participants under the age of 18 (minors) are permitted to take part in activities, but they must be accompanied by a parent or legal guardian at all times. The Parent/Guardian must sign the Waiver of Liability and Release on behalf of the minor and accepts full responsibility for the minor's conduct and safety. By signing, the Parent/Guardian agrees to all terms herein and acknowledges that they are taking full accountability for the minor's participation.

5. Pricing and Payments

All games and activities are time-based and are charged accordingly. Payment is required in full before the commencement of any activity. All sales are final and non-refundable, except at the sole discretion of Ster-Kinekor Theatres or in cases where an activity is cancelled by the company.

6. Intellectual Property

All names, logos, and trademarks associated with SK Xperience, Ster-Kinekor Theatres, and Jozi X are the property of their respective owners. The unauthorized use of any of this intellectual property is strictly prohibited.
